KuCoin Thailand (operated by ERX Company Limited (the “Company”) hereby informs you of the terms and conditions governing the closure of your account (“Terms”), which cover all matters related to account termination.
Please read these Terms carefully before submitting a request to close your account. By submitting such a request, you acknowledge that you have thoroughly reviewed and understood these Terms, and you thereby express your intent for the Company to proceed with closing your account. You also acknowledge the necessity for the Company to retain certain categories of your personal data as specified herein.
1. Account Closure Procedures
1.1 Self-Verification
· Before submitting a closure request, please review your account as outlined below. Failure to do so will be deemed as abandonment of any remaining assets in your account, which will be deducted as account closure fees. You will not be entitled to claim compensation for such assets.
· Ensure that no funds or digital assets remain in your account. If your remaining balance is less than or equal to the minimum withdrawal amount which includes applicable withdrawal fee or the minimum trading order value (in cases where no other wallet supports the digital asset), such balance cannot be withdrawn and will be deducted as a closure fee.
· Confirm that no pending buy or sell orders remain in the system. Any outstanding orders will be automatically cancelled and cannot be reinstated.
· Ensure that you have no pending disputes, complaints, or transactions under review with the Company.
· If you have any sub-accounts, this account closure process will automatically close and delete all associated sub-accounts. You must ensure that all sub-accounts have no remaining balances or pending transactions before submitting a request to close your account.
· Download your transactions history and related documents for tax purposes or personal record-keeping. The Company strongly recommends that you download the following information before closing your account:
o Trading history
o Deposit/withdrawal history
o Asset holding statement
o Tax invoice
This information cannot be retrieved after your account has been closed.
1.2 Closure Process
Once you have verified your account as per Section 1.1, you may proceed by selecting “Delete Account” via the Company’s website or application.
2. Effects of Account Closure
· Once your account has been permanently closed, neither assets nor information can be recovered. Should you wish to use our services again in the future, you must open a new account.
· No deposits may be made into a closed account. Any assets deposited after closure will be lost and cannot be retrieved.
· Any unclaimed referral rewards or promotional benefits will be forfeited and cannot be claimed.
· You will no longer receive notifications, emails, or updates from the Company.
· You may use the same email address to register a new account after your account has been permanently closed. However, you will be required to complete the identity verification (KYC) process again.
3. Data Retention Period
· The Company retains data related to account closure in accordance with industry standards, applicable laws, and regulatory requirements.
· Upon account closure, your personal data collected for service provision will be deactivated and rendered inaccessible. However, the Company is legally required to retain certain categories of personal data, which may include but are not limited to: identity verification (KYC), customer due diligence (CDD), such as name, address, phone number, photograph, bank account details, age, occupation, job title, salary, source of income, and transaction records.
· Such data will be retained for the period mandated by laws relating to Anti-Money Laundering and Combating the Financing of Terrorism Laws, Digital Asset Businesses law and other relevant laws and regulations.
· The Company will maintain your personal data under appropriate security standards solely for compliance purposes and will not use it for any other purpose without your prior consent.
· The retention period begins once your account has been permanently closed.
· Upon expiry of the legally required retention period, the Company will securely delete, destroy, or anonymize your personal data.
4. Company’s Right to Refuse Account Closure
The Company reserves the right to refuse account closure without prior notice in the following circumstances:
· Your account is under investigation by regulatory or law enforcement authorities.
· There are unresolved disputes or complaints.
· The Company suspects fraud, money laundering, or other illegal activities.
· A court order or directive from relevant authorities prohibits account closure.
· Your account has been inactive for more than 12 consecutive months.
5. Acceptance of Terms
By submitting an account closure request, you confirm that:
· You have read and understood these Terms and Conditions in their entirety.
· You consent to the Company retaining your personal data for a period as required by law.
· You acknowledge that account closure is permanent and cannot be reversed once completed.
· You acknowledge that any remaining assets in your account will be forfeited and cannot be recovered.
· You have downloaded all necessary transaction history for tax purposes.
